Time for Courts, Attorneys to Use Amended Evidence Rule

The Supreme Court has approved amended FRE Rule 702 and it is set to become final on December 1, 2023. The amendment clarifies that the rules currently require courts to act as gatekeepers on the admissibility of expert evidence and clarifies the standards for its admissibility. Hollingsworth LLP partner Eric Lasker and Atlantic Legal Foundation EVP and General Counsel Lawrence Ebner, in a Law 360 article (July 20, 2023), write that the amended rule should be applied by courts and attorneys now, and analyze the provisions of the amended rule.
