Rule 702 Amendment Should Guide District Court’s Analysis

An amicus brief filed by the Atlantic Legal Foundation in Carr v. Google LLC discusses the importance of applying the amendment to Federal Rule of Evidence 702, especially in this case, where the court’s decision is predicated on expert testimony. The expert testimony was the basis for a class action certification decision by the U.S. District Court for the Northern District of California.

The brief, prepared by Eric Lasker (Hollingsworth LLP) and Lawrence Ebner (ALF), was filed in the U.S. Court of Appeals for the Ninth Circuit on June 13, 2023.
