Courts and parties are increasingly aware that disclosure of third-party funding is necessary for understanding who controls and benefits from lawsuits. But some courts are resisting disclosure requests, and some defendants are relying on arguments that aren’t making the grade. Now that the Advisory Committee on Civil Rules is taking a new look at the possibility of amending the FRCP to require TPLF disclosure, this timely panel will examine the “how” and “why” of TPLF disclosure requests and explain how LCJ’s “Ask About TPLF” initiative can assist your efforts.

The U.S. Supreme Court’s decisions in Relentless and Loper Bright Enterprises overturned decades of deference to administrative agencies, but have created new and complicated questions. Companies are re-evaluating their regulatory environments and considering their litigation opportunities and vulnerabilities. Meanwhile, plaintiffs’ lawyers are hard at work devising ways to use the changing legal landscape to their advantage, and federal and state agencies are considering new rules and enforcement actions. This panel will examine the latest ideas and discuss how LCJ members should prepare for the new litigation terrain.

The co-chairs of LCJ’s advocacy committees will explain LCJ’s goals and how LCJ members are collaborating to accomplish meaningful reforms.

2:30 p.m. – 3:30 p.m.                   Talkin’ ‘Bout My Generation: Can Courts Require Producing Parties to Use Their Generative AI Systems to Facilitate Discovery?

While the overall impact of generative artificial intelligence on litigation remains a matter of speculation, it is already raising cutting-edge questions in discovery. Can courts require producing parties to use AI tools to find documents if it is more cost-effective than human review? Does the right to inspect documents include asking an opponent’s AI platform to identify e-mails that “discuss or identify any defect in your product”? And should courts prohibit requesting parties from loading confidential information into a public generative AI model? Our panel will discuss these and other pressing issues and share thoughts about developing new strategies for addressing the coming wave of e-discovery and evidence problems.

LCJ and its members are engaged in bolstering public confidence in the judiciary, which is critical to courts’ ability to provide fair, efficient resolution of legal disputes, including by jury trial. Unfortunately, public trust in the judiciary is low and trending lower. This panel of distinguished current and former state Supreme Court Chief Justices will share their perspectives on the problem, the solutions, and specifically how LCJ and its members can help even as we work to advocate for changes in civil rules that meet FRCP 1’s goal of the “just, speedy, and inexpensive” resolution of every action.

10:10 a.m. – 11:05 a.m.               Remote Control: Are New Rules about Remote Testimony on their Way? A Conversation with the Advisory Committee on Civil Rules

Major changes to the rules governing remote testimony in federal courts are under consideration by the Advisory Committee on Civil Rules. A proposal by plaintiffs’ lawyers would require judges to allow remote testimony unless precluded by good cause and would essentially allow nationwide subpoena power for remote testimony. Where does this proposal stand, and what are the key points under discussion? Members of the Advisory Committee will explain the key questions under consideration and give LCJ members an “open mic” opportunity to share experiences and express views.
